This Refund Policy explains how refund requests are handled when booking or working with Nic Forbes for videography, photography, filmmaking, editing, visual marketing or content creation services.

By booking a service, confirming a project, making payment, attending a shoot, or receiving any photo, video or content deliverables, you agree to this Refund Policy.

1. General refund position

Refunds are not automatically provided once a booking has been confirmed, work has started, a shoot has taken place, editing has begun, images have been edited, video edits have been created, or final files have been delivered.

Any refund request will be reviewed fairly and will depend on the circumstances, the amount of work completed, costs already incurred, the reason for the request, and whether the agreed service has been delivered with reasonable care and skill.

2. Deposits and booking fees

A 40% deposit is required at the time of booking to secure the date, unless otherwise agreed in writing.

Deposits and booking fees are non-refundable unless otherwise agreed in writing or required by law.

This is because the deposit secures the booking date, covers planning time, admin, preparation, and may prevent Nic Forbes from accepting other work for that date.

3. Client cancellations

If the client cancels a confirmed booking, the deposit or booking fee will not usually be refunded.

If the client cancels close to the shoot date, additional cancellation charges may apply in line with the Terms and Conditions.

Any third-party costs already paid or committed to, such as travel, equipment hire, accommodation, crew, cast, location fees, permits or props, may also be deducted from any refund or charged to the client.

4. Rescheduling

If the client wants to reschedule, this is subject to availability and must be agreed in writing.

Rescheduling does not automatically entitle the client to a refund.

If rescheduling causes additional costs, such as travel, accommodation, equipment hire, location fees, crew or other expenses, these may be charged to the client.

If Nic Forbes cannot attend the new proposed date, this may be treated as a client cancellation unless otherwise agreed in writing.

5. Work already started

Refunds will not usually be provided for work already started or completed.

This includes, but is not limited to:

  • Planning

  • Admin

  • Creative preparation

  • Shoot preparation

  • Travel arrangements

  • Photography

  • Videography

  • Filming

  • Image selection

  • Photo editing

  • Retouching

  • Video editing

  • Colour grading

  • Audio editing

  • Music selection

  • File exports

  • Gallery preparation

  • File uploads

  • Delivery preparation

If a refund is approved after work has started, it may be partial and may take into account the amount of work completed, time spent, expenses incurred and any third-party costs.

6. Completed work and delivered files

Refunds will not usually be provided once final photos, final videos, edited content, online galleries, download links, or other agreed deliverables have been provided to the client.

A refund will not usually be given because of a change of mind after delivery, subjective creative preference, or because the client no longer wants to use the photos, videos or content.

7. Photography-specific refunds

Refunds will not usually be provided because the client dislikes subjective photography choices, including but not limited to:

  • Image style

  • Composition

  • Angles

  • Lighting

  • Colour grading

  • Editing style

  • Retouching style

  • Image selection

  • Backgrounds or locations

  • Posing direction

  • Candid moments captured or not captured

Where a photography service has been delivered in line with the agreed brief, references, project scope or creative control terms, a refund will not usually apply.

If the client does not provide clear references, examples, shot requirements or style direction before the shoot, Nic Forbes may use creative judgement when capturing and editing the final images.

8. Videography-specific refunds

Refunds will not usually be provided because the client dislikes subjective video choices, including but not limited to:

  • Edit style

  • Pacing

  • Clip selection

  • Music choice

  • Transitions

  • Colour grading

  • Framing

  • Shot choices

  • Audio style

  • Structure

  • Storytelling approach

  • Length, where it matches the agreed scope

Where a videography service has been delivered in line with the agreed brief, references, project scope or creative control terms, a refund will not usually apply.

If the client does not provide clear references, examples, shot requirements or style direction before the shoot, Nic Forbes may use creative judgement when filming and editing the final video.

9. Creative preference

Creative work is subjective.

Refunds will not usually be given because the client dislikes the style, framing, colour, edit, sound, image selection, pacing, creative direction or overall feel of the final work where the work has been delivered in line with the agreed brief, references, project scope or creative control terms.

If the client did not provide clear references, examples, style direction or specific creative instructions before the project began, Nic Forbes may have creative freedom over the final project in line with the Terms and Conditions.

10. Revisions

Where revisions are included, the client should use the revision process to request reasonable changes.

A refund will not usually be provided where an issue can reasonably be resolved through revisions.

For photography, revisions may include reasonable adjustments to image editing, colour, cropping or retouching where possible.

For video, revisions may include reasonable adjustments to pacing, clip selection, text, music, sequence order or other edit changes where possible.

Additional revisions, major changes, new creative direction, extra retouching, extra formats, new deliverables or requests outside the original project scope may be charged separately.

Music changes for video edits may not always be possible once editing has started, as the chosen music can affect the pacing, timing, cuts, transitions, structure and overall feel of the final video.

If the client requests a music change after editing has started, this may be treated as a major revision or additional work and may be charged separately.

A refund will not usually be provided because the client changes their mind about the music after the edit has already been built around that track, unless the wrong music was used compared to what was agreed in writing before editing began.

If the client wants specific music or a specific style of music, this must be provided or agreed before editing begins.

11. Client concerns and resolution

If the client is unhappy with the delivered photos, videos or content, they should contact Nic Forbes as soon as possible and explain the issue clearly.

Where possible, Nic Forbes will try to resolve reasonable concerns through communication, revisions, corrections, replacement files, re-exporting, or another suitable solution before a refund is considered.

The client agrees to give Nic Forbes a reasonable opportunity to fix or resolve an issue before requesting a refund, where it is practical to do so.

12. Delays in delivery

Estimated delivery times are not guaranteed unless a specific deadline has been agreed in writing.

If Nic Forbes misses an agreed final project delivery deadline by more than 7 days, the client may request a partial fee reduction.

Any request for a reduced fee will be reviewed fairly and will depend on the reason for the delay, the amount of work already completed, whether the delay was within Nic Forbes’ control, and whether the client contributed to the delay by late payment, late feedback, missing information, delayed approvals, requested changes or failure to provide required assets.

A reduced fee is not automatic and will be decided at Nic Forbes’ reasonable discretion.

No fee reduction will apply where the delay is caused by the client, third-party platforms, late feedback, non-payment, additional revision requests, changes to the project scope, technical issues outside reasonable control, illness, emergencies, force majeure, or circumstances outside Nic Forbes’ control.

13. Late arrival by Nic Forbes

Nic Forbes will make reasonable efforts to arrive on time for all confirmed shoots, bookings and projects.

If Nic Forbes is running late, he will inform the client as soon as reasonably possible.

If Nic Forbes arrives late but the agreed coverage, shoot time, key moments or deliverables can still be completed, no refund or fee reduction will usually apply.

Where possible, Nic Forbes may make up the lost time by extending the shoot, adjusting the schedule, prioritising key shots or offering another reasonable solution.

If Nic Forbes’ late arrival significantly affects the agreed service, causes important moments to be missed, or prevents the project from being completed as agreed, the client may request a fair remedy.

A fair remedy may include a partial fee reduction, reshoot, replacement session, extra coverage where possible, or another suitable solution.

Any remedy will depend on the length of the delay, the reason for the delay, the impact on the final deliverables, the amount of work completed, and whether the delay was within Nic Forbes’ control.

Nic Forbes is not responsible for delays caused by circumstances outside reasonable control, including transport disruption, severe weather, accidents, emergencies, venue access issues, incorrect client information, lack of parking, road closures, public transport delays, illness or force majeure.

A full refund will not automatically apply because of late arrival unless the agreed service cannot reasonably be completed and no suitable alternative solution can be agreed.

14. Cancellation by Nic Forbes

If Nic Forbes needs to cancel or cannot complete a paid shoot due to circumstances within his control, and no suitable replacement, alternative solution or reschedule can be agreed, the client may be entitled to a refund for the affected part of the service.

If cancellation is caused by illness, emergency, unsafe working conditions, travel disruption, non-payment, client misconduct, force majeure, or circumstances outside reasonable control, refunds will be reviewed fairly based on the work completed and costs already incurred.

Nic Forbes is not responsible for losses beyond the amount paid for the affected service.

15. Refunds where Nic Forbes is at fault

If Nic Forbes has clearly failed to provide the agreed service with reasonable care and skill, the client may be entitled to an appropriate remedy.

This may include corrections, revisions, replacement files, a reshoot where reasonable, a partial refund, or a full refund, depending on the circumstances.

The remedy offered will depend on the seriousness of the issue, whether the issue can be fixed, the amount of work completed, the costs already incurred, and the impact on the final deliverables.

16. Technical issues

Creative production can involve technical risks, including equipment failure, memory card issues, file corruption, audio problems, lighting issues, camera issues, software errors, upload issues or data transfer issues.

If a technical issue occurs, Nic Forbes will take reasonable steps to fix the issue, recover files, offer an alternative solution, reschedule where appropriate, or provide a fair remedy depending on the circumstances.

A technical issue does not automatically entitle the client to a full refund.

Refunds will not usually apply where the issue was caused by venue restrictions, poor lighting, sound limitations, interference, guest behaviour, weather, access issues, client instructions, third-party equipment or circumstances outside reasonable control.

17. Consumer cancellation rights

If you are booking as an individual consumer online, by phone, email, or away from business premises, you may have a legal right to cancel within 14 days, depending on the circumstances.

If you ask Nic Forbes to begin work during the 14-day cancellation period, you agree that you may need to pay for any work already completed up to the point of cancellation.

If the service has been fully completed within the cancellation period with your agreement, you may lose the right to cancel.

This does not affect your statutory rights.

Whether the service was photography, videography, filmmaking or content creation

Reason for the refund request

Any relevant evidence or supporting information

Refund requests should be made as soon as possible after the issue arises.

Nic Forbes will review the request and respond within a reasonable timeframe.

19. Approved refunds

If a refund is approved, the amount refunded may be full or partial depending on the circumstances.

Approved refunds will usually be returned using the original payment method where possible.

A partial refund may take into account the deposit, planning time, shoot time, editing time, travel, expenses, third-party costs, completed work, delivered files, and any benefit already received by the client.

Nic Forbes will aim to make any approved partial refund fair and proportionate to the circumstances.

Refund times may depend on the payment provider, bank or platform used.

Any fees charged by banks, payment processors or third-party platforms may be deducted where applicable.

20. No automatic refunds

To protect both the client and Nic Forbes, refunds are not automatic and will always be reviewed fairly based on the circumstances of the project.

This helps ensure that clients are treated fairly where there is a genuine issue, while also recognising the time, planning, creative work, expenses and services already provided by Nic Forbes.

A refund will not usually be given simply because the client changes their mind, no longer needs the content, failed to prepare properly, gave late feedback, missed the shoot, was late, disliked subjective creative choices, changed their mind about the music after editing started, did not download files in time, or the project was completed as agreed.

A refund is also not automatic where issues were caused by venue restrictions, weather, client delays, missing information, lack of references, third-party platforms, or circumstances outside Nic Forbes’ control.

21. Changes to this refund Policy

Nic Forbes may update this Refund Policy from time to time.

The latest version will be available on this website.

The Refund Policy that applies to a project will usually be the version in place at the time the booking was confirmed, unless otherwise agreed in writing.
