These Terms and Conditions explain the terms that apply when you use this website, make an enquiry, book a service, take part in a project, or work with Nic Forbes for videography, photography, filmmaking, editing, visual marketing or content creation services.
By booking a service, confirming a project, making payment, attending a shoot, taking part in a collaboration, or using this website, you agree to these Terms and Conditions.
1. About Nic Forbes
Nic Forbes provides creative services including videography, photography, filmmaking, editing, visual marketing, social media content creation and related production services.
These Terms apply to clients, collaborators, brands, businesses, event organisers, individuals, models, performers and anyone else who works with or books services from Nic Forbes.

The exact services, deliverables, dates, timings, location, price and project details will be agreed separately in writing by email, message, invoice, quote, booking form, contract or another written agreement.
3. Quotes and project scope
Any quote provided is based on the information given by the client at the time of enquiry.
If the project changes, the price may also change. This includes changes to shoot length, location, number of deliverables, editing requirements, deadlines, travel, crew, equipment, revisions, licensing, usage, or any extra work requested.
Nic Forbes is not responsible for delivering work that was not included in the agreed project scope.
Any extra services, additional edits, extra shoot time, extra locations, additional formats, urgent deadlines or new deliverables may be charged separately.
4. Bookings
A booking is only confirmed once Nic Forbes has accepted the project and the required deposit or written confirmation has been received.
Until a booking is confirmed, dates and availability are not guaranteed.
Nic Forbes reserves the right to decline any project or enquiry at his discretion.
The client is responsible for providing accurate information before the booking is confirmed, including date, time, location, project brief, access details, key contacts, schedule, parking information, permits and any important restrictions.
Last-minute bookings made less than 24 hours before the requested shoot, service or project start time may be subject to an additional last-minute booking fee of the service, which must be paid on booking confirmation.
This fee will depend on the nature of the project, availability, preparation required, travel, equipment needs, crew requirements and the urgency of the request.
Any last-minute booking fee will be confirmed before the booking is accepted, where possible.
5. Deposits and booking fees
A 40% deposit is required at the time of booking to secure the date, unless otherwise agreed in writing.
A booking is not confirmed until the 40% deposit has been received and Nic Forbes has confirmed the booking.
Unless otherwise agreed in writing, deposits and booking fees are non-refundable because they secure the date, cover planning time and may prevent other bookings from being accepted.
If a client fails to pay the required deposit or booking fee by the agreed deadline, the booking may be cancelled or released.
The remaining balance must be paid according to the payment terms agreed in the quote, invoice, booking form or written agreement.
6. Payments
Payment terms will be confirmed in the quote, invoice, booking form or written agreement.
Unless otherwise agreed in writing, full payment must be made before final files are released without watermarks or before final delivery links are provided.
Nic Forbes reserves the right to pause work, withhold files, delay delivery or cancel remaining work if payment is late or unpaid.
Late payments may affect delivery times.
The client is responsible for paying all agreed fees, including any additional costs approved during the project.
7. Discounts and promotional offers
Any discount, promotional offer, reduced rate or special price offered by Nic Forbes is only valid if confirmed in writing.
Discounts cannot be applied after a quote, invoice or booking has already been agreed unless Nic Forbes agrees in writing.
Discounts cannot be combined with other discounts, promotions, referral offers, package deals or reduced rates unless agreed in writing.
Any discount offered applies only to the specific service, project, date, package or client stated at the time of the offer.
Discounts do not apply to additional costs, including travel, parking, accommodation, meals, extra locations, additional crew, cast, equipment, set design, props, overtime, extra revisions, urgent delivery, last-minute booking fees or third-party costs, unless agreed in writing.
Nic Forbes reserves the right to change, pause, withdraw or refuse any discount or promotional offer at any time before a booking is confirmed.
Once a booking is confirmed, the agreed discounted price will apply only to the agreed project scope. If the project scope changes, additional costs may apply.
8. Monthly retainers
Monthly retainers are ongoing service agreements where the client pays a fixed monthly fee for agreed services, deliverables or creative support.
The exact services, number of shoot days, editing time, content deliverables, usage rights, turnaround times and any included meetings or planning will be agreed in writing before the retainer begins.
Retainer payments must be made in advance unless otherwise agreed in writing.
Work will not begin for a retainer period until payment for that period has been received.
Unless otherwise agreed in writing, unused shoot days, editing time, content allowance, revisions or deliverables do not roll over into the next month.
Any work requested outside the agreed monthly retainer scope may be charged separately. This includes, but is not limited to, extra shoot days, additional edits, extra revisions, additional locations, additional crew, equipment, urgent turnaround, paid advertising usage, travel outside London Zones 1 to 6, accommodation, meals, parking or third-party costs.
Either party may cancel a monthly retainer by giving 30 days’ written notice, unless a different notice period or minimum term has been agreed in writing.
If the client cancels during a paid retainer period, refunds will not usually be given for unused services, unless otherwise agreed in writing.
If the client delays providing information, feedback, access, approvals, products, people, locations or required materials, Nic Forbes is not responsible for missed deadlines or unused retainer time.
Nic Forbes may pause or cancel a monthly retainer if payments are late, the client repeatedly delays the project, the scope changes significantly, or the working relationship becomes unreasonable, unsafe or unworkable.
Any discount or reduced rate agreed as part of a monthly retainer only applies while the retainer remains active. If the retainer ends, future work may be quoted at Nic Forbes’ standard rates.
9. Late payments
If payment is not made by the agreed deadline, Nic Forbes may send payment reminders and may pause or withhold further work until payment is received.
For business clients, Nic Forbes may be entitled to charge statutory interest and debt recovery costs on late commercial payments where applicable.
Failure to pay may result in cancellation of the project, withholding of files, or legal recovery action.
10. Client cancellations
If the client cancels a confirmed booking, the deposit and booking fee will not usually be refunded.
If the client cancels close to the shoot date, additional cancellation charges may apply, especially where Nic Forbes has already turned down other work, booked travel, hired equipment, booked crew, completed planning, or started pre-production.
Unless otherwise agreed in writing:
Cancellations made more than 14 to 7 days before the shoot may result in loss of the deposit or booking fee.
Cancellations made 7 to 2 days before the shoot may require payment of 60% of the total project fee.
Cancellations made less than 2 days before the shoot may require payment of 100% of the total project fee.
Any unavoidable third-party costs already paid or committed to may also be charged to the client.
11. Rescheduling
If the client needs to reschedule, they must contact Nic Forbes as soon as possible.
Rescheduling is subject to availability and is not guaranteed.
If the client reschedules close to the shoot date, a rescheduling fee may apply.
Any additional costs caused by rescheduling, such as travel, crew, equipment hire, location fees or accommodation, may be charged to the client.
If Nic Forbes cannot attend the new proposed date, this may be treated as a client cancellation unless otherwise agreed in writing.
12. Cancellation by Nic Forbes
If you are booking as an individual consumer online, by phone, email, or away from business premises, you may have a legal right to cancel within 14 days, depending on the circumstances.
If you ask Nic Forbes to begin work during the 14-day cancellation period, you agree that you may need to pay for any work already completed up to the point of cancellation.
If the service has been fully completed within the cancellation period with your agreement, you may lose the right to cancel.
Refunds linked to consumer cancellation rights will be handled in line with the Refund Policy available on this website.

13. Consumer cancellation rights
If you are booking as an individual consumer online, by phone, email or away from business premises, you may have a legal right to cancel within 14 days, depending on the circumstances.
If you ask Nic Forbes to begin work during the 14-day cancellation period, you agree that you may need to pay for work already completed up to the point of cancellation.
If the service has been fully completed within the cancellation period with your agreement, you may lose the right to cancel.
This does not affect your statutory rights.
14. Client responsibilities
The client is responsible for:

Providing accurate project details

Providing references, examples, style preferences or specific requirements unless full creative control has been given to Nic Forbes

Confirming shoot dates, times and locations

Ensuring access to the location

Securing venue permissions

Securing filming or photography permissions

Securing permits where needed

Informing guests, staff, attendees, or participants that filming or photography may take place

Providing schedules or key moments in advance

Providing brand assets, logos, music, graphics or other materials where needed

Ensuring that any people involved are available and prepared

For Video Editing, give timestamps on where they want changes

For Photos Give Picture File Names that they want edited

Responding to questions, approvals and feedback in a reasonable time

Making payment on time

Nic Forbes is not responsible for missed shots, delays, reduced coverage or incomplete deliverables caused by incorrect information, poor organisation, lack of access, venue restrictions, late arrivals, missing participants, poor weather, client delays or restrictions outside his control.
15. Shoot timings and overtime
Shoot start and end times will be agreed before the project.
If the shoot runs over the agreed time because of client delays, schedule changes, late arrivals, venue issues, extra requests or other circumstances outside Nic Forbes’ control, overtime may be charged.
Overtime must be agreed where possible, but if the client asks Nic Forbes to continue working beyond the agreed time, extra charges may apply.
16. Travel, parking and additional expenses
Travel costs are included for shoots within London Zones 1 to 6.
For locations outside Zone 6, additional travel expenses will apply.
If overnight accommodation is required, the cost of the stay and reasonable meals will be charged to the client.
Any unexpected parking fees, congestion charges, ULEZ charges, access fees, location costs, or unforeseen transport-related expenses may also be charged to the client.
The client is responsible for any parking, access or location costs required for the shoot.
If unexpected costs arise during the project, Nic Forbes will inform the client where possible.
17. Additional locations, crew, cast, set design and equipment
Travel costs are included for shoots within London Zones 1 to 6.
For locations outside Zone 6, additional travel expenses will apply.
If overnight accommodation is required, the cost of the stay and reasonable meals will be charged to the client.
Any unexpected parking fees, congestion charges, ULEZ charges, access fees, location costs, or unforeseen transport-related expenses may also be charged to the client.
The client is responsible for any parking, access or location costs required for the shoot.
If unexpected costs arise during the project, Nic Forbes will inform the client where possible.
18. Creative control
Nic Forbes will use professional judgement and creative skill when filming, photographing, editing and delivering the final work.
Unless the client has given full creative control to Nic Forbes, the client is responsible for providing clear references, examples, style preferences or any specific requirements before the project begins.
If the client does not provide references, examples, style direction or specific creative instructions before the project begins, Nic Forbes will have creative freedom over the final project.
The client accepts that creative work is subjective and that the final style, pacing, framing, colour, sound, edit choices and overall creative approach may reflect Nic Forbes’ creative judgement unless specific requirements have been agreed in writing before the project begins.
References and examples can be used as guidance, but they do not guarantee an exact copy of another creator’s style.
Any major change in creative direction after filming, photography or editing has started may be treated as extra work and may be charged separately.
19. Revisions and edits
The number of included revisions will be confirmed in the quote, invoice, booking form or written agreement.
Unless otherwise agreed in writing, one round of reasonable revisions is included.
A revision means a reasonable adjustment to the agreed photo or video deliverable.
For video, revisions may include minor changes to pacing, text, clip selection, sequence order, audio levels or music where possible.
For photography, revisions may include reasonable adjustments to exposure, contrast, colour, cropping, straightening, basic retouching or other light image adjustments where possible.
Revisions do not include a full re-edit, full re-selection of images, change of concept, new creative direction, new music that affects the video timeline, additional deliverables, extra formats, advanced visual effects, new filming, new photography, new graphics, heavy retouching, body reshaping, background removal, complex image manipulation, or changes caused by unclear or missing instructions from the client.
Additional revisions, major changes or requests outside the agreed project scope may be charged separately.
The client must provide revision requests within 7 days of receiving the draft, preview, gallery or edited content, unless otherwise agreed in writing.
20. Urgent delivery and rush edits
Any request for urgent delivery, priority editing, same-day edits, next-day edits or delivery faster than the agreed timeline may be subject to an additional rush fee.
Rush delivery is subject to availability and is not guaranteed.
Any rush fee will be confirmed before the urgent work begins, where possible.
Rush delivery may not be available for larger projects, complex edits, events over 5 hours, weddings, films or projects requiring detailed post-production.
21. Delivery times
Estimated delivery times will be discussed before or during the project.
Delivery times are estimates and are not guaranteed unless a specific deadline has been agreed in writing.
Delivery may be delayed if the client delays payment, feedback, approvals, assets, information or access.
Nic Forbes is not responsible for delays caused by third-party platforms, internet issues, illness, emergencies, technical problems, equipment failure, data transfer delays or circumstances outside reasonable control.
If Nic Forbes misses an agreed final project delivery deadline by more than 7 days, the client may request a partial fee reduction.
Any request for a reduced fee will be reviewed fairly and will depend on the reason for the delay, the amount of work already completed, whether the delay was within Nic Forbes’ control, and whether the client contributed to the delay by late payment, late feedback, missing information, delayed approvals, requested changes, or failure to provide required assets.
A reduced fee is not automatic and will be decided at Nic Forbes’ reasonable discretion.
No fee reduction will apply where the delay is caused by the client, third-party platforms, late feedback, non-payment, additional revision requests, changes to the project scope, technical issues outside reasonable control, illness, emergencies, force majeure, or circumstances outside Nic Forbes’ control.
22. File delivery
Final files may be delivered using third-party platforms such as Google Drive, WeTransfer, Dropbox, Pixieset, email or other suitable delivery methods.
The client is responsible for downloading, saving and backing up final files within the available download period.
Nic Forbes is not responsible for files not downloaded by the client within the available access period.
The client may request that the file be resent. Any such request will be fulfilled subject to Nic Forbes’ availability and within a reasonable timeframe.
23. Raw footage and project files
Raw footage, unedited images, project files, timelines, editing files and working files are not included unless agreed in writing.
If raw footage or project files are requested, this may be subject to an additional fee and may not always be available.
Raw footage is usually kept for 45 days after the service has been completed. After this period, raw footage may be permanently deleted.
Final edited videos and completed content are usually kept for 3 months after the service has been completed. After this period, final edited content may be permanently deleted.
Clients are responsible for downloading, saving and backing up delivered files within the stated timeframes.
Nic Forbes is not responsible for providing copies of raw footage, final edited content or project files after the relevant storage period has ended.
24. Credit and tagging
Paid clients are encouraged to credit or tag Nic Forbes when posting delivered content online.
For collaboration projects, unpaid work, low-paid work, test shoots or portfolio shoots, Nic Forbes must be clearly credited when the content is posted, published or shared publicly.
Credit should include tagging Nic Forbes’ relevant social media account where possible, or naming Nic Forbes as the photographer, videographer, filmmaker or content creator.
If collaboration or unpaid work is posted without credit, Nic Forbes may request that credit is added, the post is corrected, or the content is removed where appropriate.
Nic Forbes must not be falsely credited for work that has been heavily edited, altered or changed by someone else without permission.
25. Ownership and copyright
Unless otherwise agreed in writing, Nic Forbes owns the copyright in all photos, videos, edits, films, footage and creative work created by Nic Forbes.
Once full payment has been received, the client receives a licence to use the final agreed deliverables for the purposes agreed in the project scope.
Ownership of copyright does not automatically transfer to the client unless this is clearly agreed in writing.
The client must not claim authorship of the work, resell the work, license the work to others, submit the work for commercial broadcast, use the work in paid advertising beyond the agreed scope, or edit the work in a way that damages Nic Forbes’ reputation unless permission has been given in writing.
26. Client usage rights
The client may use the final delivered content for the agreed purpose, such as website, social media, internal marketing, event memories, promotional use or campaign use, depending on the project agreement.
Any usage beyond the agreed scope may require additional permission and additional fees.
This includes, but is not limited to:

Television or cinema use

Large-scale commercial campaigns

Third-party brand use

Resale

Licensing to another business

Use by an agency or partner not included in the original agreement

Use after an agreed licence period has ended
27. Nic Forbes’ portfolio and marketing use
Unless otherwise agreed in writing before the project begins, Nic Forbes may use selected images, video, audio, behind-the-scenes content and final edited content from paid client projects for:

Social media
-
Showreels
-
Marketing materials
-
Promotional campaigns
-
Advertising
-
Business proposals
-
Creative showcases
-
Behind-the-scenes content

If a paid client does not want their project, brand, event, images, video or final edited content to be used for portfolio or marketing purposes, this must be agreed in writing before the project begins.

Once paid work has been created and published or used for portfolio, marketing or promotional purposes, Nic Forbes is not automatically required to remove, delete or stop using the content unless there is a legal reason to do so or a separate written agreement states otherwise.
28.Confidential projects
If a project is confidential, embargoed or not yet public, the client must tell Nic Forbes in writing before the project begins.
Nic Forbes will take reasonable steps to keep confidential project information private where confidentiality has been agreed in writing.
Confidentiality does not apply to information that is already public, independently known, required by law, or shared with permission.
If the client requires a specific non-disclosure agreement, this must be provided and agreed to before the project begins.
29. Collaboration work
For collaboration projects, creative shoots, portfolio work, test shoots, promotional content, unpaid projects, low-paid projects and similar arrangements, Nic Forbes may use the images, video, audio, behind-the-scenes content and final edited content for:

-
Marketing materials
-
Promotional campaigns

Business proposals

Behind-the-scenes content
By taking part in a collaboration project, you agree that Nic Forbes may film, photograph, edit, publish and use the content for the purposes listed above.
Collaboration content does not need to be removed or deleted once published unless required by law or agreed separately in writing.
Any collaborator who does not agree to these terms must raise this in writing before the shoot takes place.
Final deliverables for collaboration projects will only be provided if they have been agreed in writing before the shoot takes place.
Unless otherwise agreed in writing, collaborative work does not guarantee delivery of final photos, final videos, edits, raw footage, project files, behind-the-scenes content, social media cutdowns, or any specific number of images or videos.
Nic Forbes may choose which content is edited, delivered, published or used for portfolio and marketing purposes.
Any estimated delivery date for collaboration work is not guaranteed unless agreed in writing.
Raw footage, unedited images, project files and working files are not included in collaboration work unless agreed in writing.
If a collaborator requires specific deliverables, deadlines, edits, usage rights or file formats, this must be agreed in writing before the project takes place and may be subject to a separate fee.
30. Music, licences and third-party materials
Where music, fonts, stock footage, graphics, templates, plugins or other third-party materials are used, these may be subject to third-party licence terms.
The client is responsible for making sure any materials they provide, such as logos, music, images, footage, fonts or brand assets, are legally allowed to be used.
Nic Forbes is not responsible for copyright claims, licensing issues or legal disputes caused by materials supplied by the client.
If the client wants specific music, assets or licensed materials, additional licence costs may apply.
31. Social Media Platforms
Nic Forbes is not responsible for how social media platforms compress, crop, restrict, remove, mute, flag or display delivered content.
The client is responsible for following the rules of any platform they upload content to, including Instagram, TikTok, YouTube, Facebook, LinkedIn or any other platform.
If extra versions are needed for specific platforms, such as vertical, square, widescreen, captions, thumbnails or cutdowns, these may be charged separately unless included in the project scope.
32. Website use
You agree not to misuse this website, attempt to hack it, copy its content without permission, upload harmful material, interfere with its operation, or use it for unlawful purposes.
All website content, including text, images, video, branding, layout and creative work, belongs to Nic Forbes unless otherwise stated.
You must not copy, reproduce, distribute or use website content without written permission.
33. Testimonials and reviews
If you provide a testimonial, review or feedback, Nic Forbes may use it for marketing, website, social media or promotional purposes.
Minor edits may be made for spelling, grammar, clarity or length, but the meaning will not be changed.
34. Data protection and privacy

The Privacy Policy explains what personal information is collected, how it is used, how long it is kept, and what rights individuals have.
35. Safety and conduct
Nic Forbes has the right to stop or leave a shoot if there is threatening behaviour, harassment, unsafe conditions, illegal activity, serious disrespect, discrimination, violence, dangerous environments, or any situation that puts people, equipment or work at risk.
If a shoot is stopped because of client behaviour, guest behaviour, unsafe conditions or circumstances caused by the client, the client may still be required to pay the full agreed fee.
36. Equipment failure and technical issues
Nic Forbes takes reasonable care to use suitable equipment and backup practices where appropriate.
However, creative production can involve technical risks, including equipment failure, memory card issues, file corruption, audio problems, lighting issues, software errors or data transfer issues.
If a technical issue occurs, Nic Forbes will take reasonable steps to fix the issue, recover files, offer an alternative solution, reschedule where appropriate, or provide a fair remedy depending on the circumstances.
Nic Forbes is not responsible for issues caused by venue restrictions, poor lighting, sound limitations, interference, guest behaviour, weather, access issues, client instructions, third-party equipment or circumstances outside reasonable control.
37. Limitation of liability
Nic Forbes will provide services with reasonable care and skill.
Nothing in these Terms limits liability where it would be unlawful to do so.
To the fullest extent permitted by law, Nic Forbes is not responsible for indirect loss, loss of profit, loss of business, loss of opportunity, loss of reputation, emotional distress, disappointment, or losses caused by circumstances outside reasonable control.
Nic Forbes’ total liability will not exceed the amount paid by the client for the affected service, unless the law says otherwise.
38. Force majeure
Nic Forbes is not responsible for failure or delay caused by events outside reasonable control, including but not limited to illness, injury, emergencies, extreme weather, transport disruption, strikes, venue closure, power failure, internet failure, equipment failure, government restrictions, acts of God, fire, flood, civil unrest or other unexpected events.
Where possible, a new date or alternative solution will be discussed.
39. Complaints
If you are unhappy with a service, you must contact Nic Forbes as soon as possible and explain the issue clearly.
Complaints should be sent to:
Nic Forbes will try to resolve complaints fairly and professionally.
A complaint does not automatically entitle the client to a refund, especially where the service has been delivered as agreed or where the issue is based on subjective creative preference.
40. Changes to these Terms
Nic Forbes may update these Terms and Conditions from time to time.
The latest version will be available on this website.
The Terms that apply to a project will usually be the Terms in place at the time the booking was confirmed, unless otherwise agreed in writing.
41. Governing law
These Terms and Conditions are governed by the laws of England and Wales.
Any disputes will be dealt with by the courts of England and Wales, unless the law requires otherwise.
